Rules for Compensation Payments According to Article 27.1.6 of the Law of the Republic of Azerbaijan "On Compulsory Insurance":
1. In what cases is compensation paid?
- If harm to health is caused by an unknown or stolen vehicle.
- If harm is caused by a person without a compulsory insurance contract, and the damage is not compensated.
2. Who has the right to claim compensation?
- Individuals injured in a traffic accident.
- In the event of the victim's death, their family members.
3. Compensation amounts for health damage:
- Death:
- Death or being declared dead by a court decision: 5000 AZN.
- Disability:
- Group I disability or limited health capabilities up to 18 years: 4000 AZN.
- Group II disability or limitations for 5 years: 3000 AZN.
- Group III disability or limitations from 6 months to 2 years: 2000 AZN.
- Injuries:
- Moderate or severe injury: 1500 AZN.
- Minor injury: 750 AZN.
4. Grounds for compensation payment:
- A valid court decision must be submitted.
5. Calculation of compensation:
- Any previously compensated amount is deducted from the compensation.
- If the total liability for one case exceeds 50,000 AZN, compensation is paid proportionally.
6. In case the insurer cannot fulfill obligations:
- The Compulsory Insurance Bureau ensures the payment.
7. In case of false information:
- The Bureau may demand the return of full or partial compensation.
8. Rights transferred to the Bureau:
- The injured party's claim rights, up to the amount of compensation paid, are transferred to the Bureau.
These rules ensure fair compensation for health damage in accordance with the law.
